CONSTITUTIONAL ACT

of 20 September 1990

that amends the Constitution of the Czech and Slovak Federal Republic, in the wording of the following acts

The Federal Assembly of the Czech and Slovak Federal Republic has enacted the following constitutional act:

Art. I

The Constitutional Act No. 100/1960 Coll., the Constitution the Czech and Slovak Federal Republic, in the wording of the following acts, is amended and supplemented as follows:

1. Art. 6 is deleted.

2. Art. 101 is supplemented by paragraph 6, that reads as follows:

“(6) Proposals for appointment and dismissal pursuant to paragraphs 1, 2 and 5 are submitted to the Federal Assembly by the authorized member of the Government of the Czech and Slovak Federal Republic and to the National Council by the relevant Minister of Justice.”.

3. The current wording of Art. 102 is designated as paragraph 1 and a new paragraph 2, that reads as follows, is added:

“(2) After their election judges shall take the following oath of office: ‘I promise upon my honor and conscience that I will observe the constitutional [laws] and the other laws, and make decisions according to my best convictions, independently and impartially.’”.

Art. II

Settlement of property administered by the former National Front and settlement of claims from labour-law relationships of employees of the former National Front shall be secured by the Government of the Czech and Slovak Federal Republic and Governments of the Czech Republic and the Slovak Republic.

Art. III

In Act No. 36/1964 Coll., on the Organisation of Courts and Election of Judges, in the wording of the following acts:

1.Section 42 para. 1 shall be repealed,

2. In Section 42 para. 2 the word “this [tohoto]” shall be deleted,

3. Sections 43 paras. 1 and 2 shall be repealed.

Art. IV

This Constitutional Act shall enter into effect on the day of its promulgation.
